Banking Law

Gail advises banks and other finanical service providers on complex and day-to-day regulatory compliance issues. She reviews and drafts financial institution policies, for example privacy policies and red flag policies. She also reviews and drafts consumer loan and deposit documentation such as promissory notes and security agreements, modification agreements, credit and debit card documentation, and home equity line of credit agreements. She recommends procedures for addressing consumer protection regulations, such as Fair Lending, Truth-in-Lending, Fair Credit Reporting, RESPA, Electronic Funds Transfers, and Wisconsin law. Gail drafts and negotiates all kinds of agreements between financial service providers and third party service providers, including internet service vendor agreements, correspondent loan agreements and marketing agreements. She also drafts agreements between banks and their customers, including, remote deposit capture agreements, merchant agreements and internet banking agreements.

Gail represents many lenders in commercial loan transactions and has a particular expertise in commercial real estate loans.

Gail regularly works with the Wisconsin Bankers Association to educate bankers on lending issues and consumer compliance issues. She also assists the Financial Institution Products Corporation (FIPCO) with the preparation of loan and deposit forms and provides legal review of software for automated loan and deposit processing. In addition, she provides the documentation for commercial loans, with an emphasis on real estate lending.

Practice Experience

Gail began her career in 1983 in Phoenix, Arizona at the law firm of Fennemore Craig where she practiced real estate law, representing banks and developers in real estate loan transactions. She moved to Wisconsin in 1988, and worked for a year as in-house counsel to the Wisconsin Bankers Association. She joined the Banking Group of Boardman Law Firm in 1990.
